Personal Data Protection Information Text This Information Text Pursuant to the PDP Law primarily explains, in accordance with the Personal Data Protection Law No. 6698 (“PDP Law”);
- What types of data are collected through the website www.modernelektronik.com.tr (“Site”) of MODERN ELEKTRONİK SES VE BÜRO SİSTEMLERİ SAN.TİC.A.Ş (“MODERN ELECTRONICS”), how your collected data is used, and with whom Modern Electronics may share your data,
- What your rights are over the data processed by MODERN ELECTRONICS and how you can exercise these rights,
- How you can change your positive or negative preferences regarding receiving electronic commercial messages.
Why Do We Process Your Personal Data? Which Personal Data Do We Process?
In order to provide better service to you, our Members; to manage and complete your order processes and ensure communication regarding them; to provide you with information about products, services, campaigns, and promotions; to better understand your shopping preferences, conduct trend and statistical analyses, and enhance the security of the Site, as well as to fulfill our legal obligations arising from the Law No. 5651 on the Regulation of Publications on the Internet, Law No. 6563 on the Regulation of Electronic Commerce, Turkish Penal Code No. 5237, and Personal Data Protection Law No. 6698 and the secondary legislation thereof, we process certain data that directly or indirectly identifies you, including but not limited to your name, surname, email address, phone number, gender, date of birth, Turkish ID number, tax ID number, personal interests, billing and delivery addresses; and, if you connect through your social media accounts, any information you have consented to share via those platforms.
Apart from these data, we also collect and process non-personal aggregated statistical data such as frequency and times of Site visits, order timestamps and the IP address at the time of the order, statistics regarding visited product pages and ordered products, for the purpose of analyzing and understanding visitor behavior and preferences.
We process and store these personal data with your explicit consent for the purpose of enabling you to benefit from the services we offer on the Site, or when directly related to the establishment or performance of the contract we have with you, or when required for our legitimate interests provided that it does not harm your fundamental rights and freedoms, and only within the purposes and scope defined in this Information Text Pursuant to the PDP Law, while also taking appropriate information security measures.
We use some of your data collected in our database for periodical campaign activities, special promotional activities tailored to customer profiles, customer segmentation processes to prevent unwanted emails, and in accordance with relevant legal regulations. If you use a credit card to pay for a product, you accept that your credit card number, expiration date, CVV2 code, and similar information will be shared with banks. However, the credit card and/or debit card information used during the order process is never stored in our systems.
If you request the creation of a customer record by providing your contact information in our stores, your personal data may be collected verbally during your communication with store personnel. Personal data collected during customer registration processes may be used to verify your contact information; to create campaign and promotions tailored to your consumer behavior with your explicit consent; to send you direct commercial electronic messages for marketing purposes regarding our products and services; and to create and follow necessary records in our systems to facilitate your return and exchange processes. MODERN ELECTRONICS is free to retain all records of a terminated membership account provided that they are anonymized. Once anonymized, the data loses its quality of identifying a person and is therefore no longer considered personal data. The Member has no right to make any claim or request compensation regarding anonymized records.
We may share your personal data with third parties we cooperate with to provide our services (such as companies offering cargo, delivery, call center, and database services) and with government authorities as required by our legal obligations. MODERN ELECTRONICS may share your personal data regarding your Site visit or membership and your traffic data such as browsing information with public institutions and organizations legally authorized to request such data for your security and for MODERN ELECTRONICS’ fulfillment of its legal obligations. Additionally, we undertake not to use or share your personal data for any commercial purpose other than the activities listed above and situations required by relevant legislation.
What Are Your Rights Regarding Your Personal Data and How Can You Exercise These Rights?
MODERN ELECTRONICS is legally required to keep certain Member information. However, the Member always reserves the right to be informed about their personal data, access such data, request their correction or deletion, and to inquire whether they are used in line with their intended purpose.
In accordance with Article 11 of the PDP Law, to the extent that your personal data is processed by MODERN ELECTRONICS and that MODERN ELECTRONİCS acts as the data controller, you may submit a written application to the address Nispetiye Mah. Aydın Sokak No.10, 34340 1. Levent / Istanbul or send an email to modernelektronik@hs03.kep.tr using your secure electronic signature, mobile signature, or the email address you previously shared with us during membership which is also registered in our systems, to request: whether any of your personal data is processed;
- Information regarding the processing activities of your personal data;
- The purposes for which your personal data is processed;
- If your personal data is transferred domestically or abroad, information regarding these third parties;
- Correction of your personal data if they are incomplete or incorrect;
- Deletion or destruction of your personal data if the reasons requiring processing no longer exist or if the Company has no legal grounds or legitimate interest to continue processing such data;
- A request that third parties authorized by the Company and processing your personal data comply with your rights listed in this section;
- Objection to any unfavorable outcomes arising from the processing of your personal data by automated systems; and
- The right to request compensation if you incur damage due to unlawful processing of your personal data.
You may update your membership and communication preferences at any time by logging into the system.
For How Long Are Your Personal Data Stored?
In accordance with the Law No. 6563 on the Regulation of Electronic Commerce; records related to the withdrawal of consent shall be stored for 1 year from that date; and the content of commercial electronic messages and other related records of the transmission shall be stored for 3 years to be submitted to the relevant ministry when required. After these periods expire, your personal data will be deleted, destroyed, or anonymized by our company or upon your request.
How Are Your Personal Data Protected?
MODERN ELECTRONICS attaches great importance to the protection of personal data. MODERN ELECTRONICS takes necessary measures to protect personal data from unauthorized access or loss, misuse, disclosure, alteration, or destruction.
MODERN ELECTRONICS undertakes to keep your personal data confidential, to take all necessary physical, technical, and administrative measures to ensure confidentiality and security, and to exercise due diligence. Despite MODERN ELECTRONICS taking necessary information security measures, in the event that personal data is damaged or accessed by third parties due to attacks on the Site or system, MODERN ELECTRONICS will promptly notify you and the Personal Data Protection Authority and take necessary measures.
Changes
MODERN ELECTRONICS may change this Information Text Pursuant to the PDP Law at any time. Such changes shall become effective immediately upon the publication of the amended terms and/or policies on the Site. In such a case, necessary notifications will be made to you, our Members.
